ABC of Pennsylvania Prevails in Fight Against ‘Best Value’ Bid Process

On May 18, 2006, the Pennsylvania chapters of ABC prevailed in its fight to block a proposed Pennsylvania Department of General Services (DGS) plan that would award state construction contracts using a closed, secretive bidding process, known as “best value.”

Since its inception, ABC and the merit shop construction community have been virtually shut out of the planning and implementation of the DGS’ new “Best Value” policy, which awards potentially billions of dollars of construction contracts in a secretive and subjective manner. DGS’ lack of initial communication with ABC and the merit shop construction community is particularly troubling given the fact that the DGS policy now takes the usual public, transparent contracting process behind closed doors; creates the potential for fraud and abuse in the award of billions of dollars of contracts; and severely curtails an individual contractor’s statutory protest rights.

Position on Pennsylvania Dept. of General Services' RFP Proposal for Best Value Contracting

Pennsylvania Associated Builders & Contractors, Inc. (ABC PA) opposes the Pennsylvania Department of General Services RFP proposal eliminating the current open and fair bidding system in lieu of a discriminatory, potentially costly, uncompetitive, arbitrary, and misleading procurement system known as “best value.” “Best value” is a term created by the building trades to eliminate the lowest responsible bidder system currently in place in Pennsylvania . This proposed procurement system will lead to administrative and arbitrary awarding of work regardless of the cost of the project, and it will promote political favoritism and corruption for state funded construction in Pennsylvania.

ABC PA Files Lawsuit Against Secretive Best Value Process

State’s Best Value could lead to billions of dollars in state taxpayer funded construction contracts awarded behind closed doors

MANHEIM (October 11, 2005) – The Pennsylvania Chapters of the Associated Builders and Contractors (ABC PA) has filed a complaint in Commonwealth Court today to stop the Pennsylvania Department of General Services from moving forward with a new controversial plan, known as “Best Value,” which could lead to the awarding of billions of dollars in construction contracts behind close doors.

Commonwealth Court Agrees to let ABC PA Complaint Against DGS to Proceed

MANHEIM (February 27, 2006) – On February 23, the Commonwealth Court of Pennsylvania rejected the Department of General Services’ attempt to dismiss Associated Builders & Contractors, Inc.’s (ABC’s) complaint challenging the DGS’ new, closed-door policy to award construction contracts for potentially billions of dollars.
